Terms and Conditions (T&C)

Welcome to sunwearpro (“we,” “us,” “our”). These Terms and Conditions (“T&C”) govern the use of our website www.sunwearpro.com (the “Website”) and the purchase of products, including our sunglasses and accessories (the “Products”). By accessing the Website or placing an order, you agree to these T&C. Please read them carefully.

Company Information

This Website is operated by sunwearpro based in Neuchâtel, Switzerland.

You must be at least 18 years old to place an order with us.

Products

We strive to present our Products, colors, images, and descriptions as accurately as possible. However, actual product appearance may vary depending on your device settings. All offers are non-binding. We reserve the right to modify or discontinue Products at any time.

Orders & Contract Formation

By placing an order, you submit a binding offer to conclude a purchase contract.

The contract is formed once we confirm your order by email or dispatch the Products.

Prices are stated in CHF and include statutory VAT where applicable.

Payment

Payment is made using the methods offered on the Website (credit card, PayPal).

The purchase price is due immediately and must be paid in full before the Products are shipped.

Delivery

We deliver within Switzerland (and optionally abroad). Delivery times provided are estimates and non-binding, unless otherwise expressly agreed.

Risk passes to the customer upon handover of the Products to the customer or to a third party commissioned by the customer.

Returns & Withdrawal

Under Swiss law, there is no statutory general right of withdrawal for online purchases. However, we voluntarily grant you a 14-day return period from the date of receipt, provided the Products are unworn, undamaged, and returned in their original packaging. Return shipping costs are borne by the customer unless the Products are defective or incorrectly delivered.

Defects & Warranty

The statutory warranty under Articles 197 et seq. of the Swiss Code of Obligations (OR) applies. In addition, we provide a  6-month warranty against manufacturing defects on sunglasses. Excluded from warranty are damages caused by improper handling, normal wear and tear, or scratches on lenses.

Liability

We are only liable for damages caused intentionally or by gross negligence.

Liability for indirect damages, consequential damages, or loss of profit is excluded to the extent permitted by law.

Intellectual Property

All content (texts, images, logos, designs) on this Website is the property of sunwearpro or licensed to us. Any use without our consent is prohibited.

Governing Law & Jurisdiction

These T&C are governed by substantive Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction is Neuchâtel, unless mandatory statutory provisions provide otherwise.

Changes to the T&C

We may amend these T&C at any time. Changes take effect upon publication on the Website.
